Pellican is probably hoping to implicitly raise it anyway and therefore get some sympathy from the jury but it is very unlikely this tactic will work (especially with him representing himself). As far as the government charging Fields and the rest, without Pellicano testifying against them the government could never have proved a conspiracy case against them. Did they know Pellicano was breaking the law? Sure. Was it provable beyond a reasonable dout?
